Closing of investigation No VIZSG/16/2024 – Construction of a nursery in Baktakék

Based on a whistleblower report, the Integrity Authority has concluded an investigation into Project ID TOP-1.4.1-16-BO1-2017-00021, the aim of which was to build new a nursery in Baktaték with a capacity of 48 children across four groups. The Municipality of Baktakék was awarded HUF 265,166,892 in European Union funds for the project.

The Authority’s investigation found that the project had not been prepared with sufficient diligence, which resulted in the repeated modification of its milestones and completion date.

The Authority initiated remedy proceedings with the Public Procurement Arbitration Board in connection with the public procurement procedures related to the project, due to practices and omissions uncovered during the investigation, which the Authority deemed likely to be in violation of the Public Procurement Act. In its decision, the Public Procurement Arbitration Board granted all elements of the Authority’s initiative and imposed a total fine of HUF 3 million.

Furthermore, the Authority requested that the Public Procurement Authority examine, as part of an administrative audit, whether the contracting authority had lawfully enforced its claims arising out of a breach of contract, based on the contract concluded with the contractor. The Public Procurement Authority has concluded its contract review. The review has found that the project had not been prepared with sufficient diligence, resulting in the repeated modification of its milestones and completion dates.
