In its decision no. 09000/436-23/2023.bü., the Department of Economic Protection of the Criminal Directorate of the Hajdú-Bihar County Police Headquarters rejected the complaint filed for the suspicion of agreement in restraint of competition in public procurement and concession procedures committed by the conclusion of an agreement or by taking part in any other concerted practices due to the lack of suspicion of a criminal act.

The Integrity Authority has submitted a motion for revision against the decision of the investigating authority that had rejected the complaint, and proposed that the decision of the investigating authority be abrogated and an investigation be ordered.

An article published on online portal, which forms the basis for the complaint in the case, reported that a company in Hajdúböszörmény had won hundreds of public procurement contracts, including fifty-eight restricted procedures, in a way that raises the suspicion of corruption.

According to the Authority’s motion for revision submitted on 11 March 2024, the decision that rejected the complaint and the published anonymised file register showed that the investigating authority had not carried out any detailed investigative action in the case and had left several suspicious circumstances uninvestigated.

According to the Authority, it is necessary to order an investigation in view of the fact that, on the basis of the emerging patterns, there was presumably no genuine competition in the public procurement procedures concerned, which is also confirmed by the fact that the company in question typically won the tenders against the same companies and that the winning tender price deviated only to a strikingly small extent from the estimated value previously calculated by the contracting authority.
