Investigation report of the Authority

If the Authority has conducted an investigation procedure in order to identify circumstances that adversely affect or may adversely affect the implementation of European Union financial support, it assesses the information acquired in the course of the investigation by issuing a report if another measure is not justified.

The Authority may provide, while ensuring a reasonable deadline, an opportunity for the person or organisation concerned in the report to comment on the draft report prior to the issuance of its report.

In order to further the objectives of the investigation procedure, the Authority may make recommendations, while setting a deadline, to the person or organisation investigated in the procedure. The person or organisation under investigation must notify the Authority of the implementation of these recommendations or, if in disagreement with such recommendations, of the motives for disagreement.

The Authority may initiate proceedings at the competent authority or court if it identifies anomalies concerning the use of European Union funds or regards the implementation of its recommanded measures inadequate.
