Decision by the public prosecutor’s office in response to motion for revision no. JOG/57/2024 of the Authority

In its decision no. 29022/308/2024.bü, the Anti-Corruption Department of the Anti-Corruption and Economic Crimes Division at the National Bureau of Investigation, part of the Rapid Response and Special Police Service, dismissed the complaint filed on the suspicion of misappropriation of funds, stating that the reported action does not constitute a criminal offence.

On 3 July 2024, the Integrity Authority filed motion for revision no. JOG/57/2024 against the investigating authority’s decision dismissing the complaint, proposing the abrogation of the investigating authority’s decision and the initiation of an investigation.

In its decision issued on 17 July 2024, the Prosecution Office of Budapest District IX, acting in the case in response to the Authority’s motion for revision, found the motion for revision to be well-substantiated, admitted the motion, abrogated the above decision of the investigating authority dismissing the complaint, and ordered an investigation on the suspicion of misappropriation of funds resulting in substantial financial loss and on suspicions of agreement in restraint of competition in public procurement and concession procedures.

The public prosecutor’s office maintains that clarifying the statements of facts in the complaint and the motion for revision is possible only within the confines of an investigation.

No legal remedy against the decision of the public prosecutor’s office will be entertained.
