In its decision no. 01000/2771/2023.bü., the Economic Fraud Division of the Budapest Police Headquarters terminated the proceedings against unknown person for the suspicion of misappropriation of funds resulting in particularly substantial financial loss, as the act is not a criminal act.

The Integrity Authority has submitted a motion for revision against the decision of the investigating authority that terminated the proceedings, and proposed that the decision of the investigating authority be abrogated and the proceedings be resumed.

According to the complaint, an online portal obtained two official letters in relation to the case, which state that the contractor carrying out the second phase of an IT and communications systems project of a state company had not delivered properly.

According to the Authority’s motion for revision submitted on 8 November 2023, the justification of the decision that terminated the procedure and the published anonymised file register show that the investigating authority did not perform any detailed data-gathering activity or investigative act, even though several circumstances emerged based on the information contained in the complaint that the investigating authority did not investigate in detail on the basis of the available information and the information at the Authority’s disposal. According to the Authority, the investigating authority must take legal proceedings on the suspicion of misappropriation of funds, abuse of authority, and professional misconduct, while the National Tax and Customs Administration must take legal proceedings on the suspicion of budget fraud. In addition, there may also be a suspicion of environmental damage and violation of waste management regulations.
